TERMS OF SALE

These Terms of Sale define the procedure for ordering, payment, delivery, and complaint handling of products offered on the hugyourlife.hr website. The Supplier (Seller) of the products offered on the hugyourlife.hr website is Luminus Mod d.o.o., and the Buyer of the goods is a visitor of the hugyourlife.hr website who selects at least one product, completes the electronic order form, and submits it to the Seller. The Buyer can also order products by phone with human assistance.

The Buyer must be a legal adult and capable of conducting business. Contracts on behalf of minors and fully legally incapacitated persons may be concluded by their legal representatives or guardians, while partially legally incapacitated persons may enter into contracts only with the consent of their legal representatives or guardians. The Seller bears no responsibility for actions contrary to this provision.

By accepting the terms of sale, the Buyer declares that all data provided about themselves are true and complete, that they are legally capable of conducting business, and that there are no known impediments to ordering and purchasing products from the Seller, i.e., for purchasing via the electronic sales point – webshop.

The sales contract is concluded upon receipt of payment.

The Seller may inform the Buyer about new products, products on sale, and similar items (via Newsletter). After successful registration (with all required data correctly filled out), the Buyer will receive a notification of successful registration via email. The Buyer can unsubscribe from the Newsletter at any time.

PRODUCTS OR SERVICES

Luminus Mod d.o.o. will strive to ensure maximum accuracy of information and data contained on this website. Product images are illustrative and do not guarantee that the image fully corresponds to the product itself. We do not take responsibility for possible unintentional errors in product descriptions. Differences between the actual product and the description on these pages may occur if the manufacturer changes any characteristics or composition of the product. All descriptions are regularly and thoroughly reviewed.

PRICES

Prices displayed on the website alongside each product are in Euros (€), inclusive of value-added tax, and apply to all forms of payment. For e-banking and general payment slips, transaction costs and/or interbank transaction fees are not included in the price.

The Seller may offer specific discounts on purchases made through the webshop for a limited period. Displayed prices apply to all payment methods. The Seller reserves the right to change prices without prior notice. Furthermore, the Seller is authorized to determine discounts, daily or weekly promotions, promotions for specific products, product groups, and/or all products without prior notice.

Payments are always processed in Euros. PayPal conducts currency conversion according to its own exchange rates for the sales currency (EUR, USD, etc.). For more detailed information, please visit PayPal’s website, where you can also contact them in case of any issues related to your PayPal account.

ORDERING

You can order and purchase as a Guest or as a Registered user. A product is considered ordered when the buyer completes the entire ordering process. Goods are ordered via an electronic form on the hugyourlife.hr website. Ordering goods is possible 24 hours a day, 7 days a week. Orders are processed Monday to Friday from 8:00 AM to 4:00 PM. The buyer will be notified via email about the completed order.

Select the desired item. For more information about the selected item, click on its image or text, and you will be redirected to a page with more product information. By clicking on the “Add to Cart” icon, the selected product is saved in the shopping cart, and you can proceed to purchase by selecting “Checkout.” Alternatively, you can choose the “Return to Shop” option to select another item from the offer and add it to the cart. In the cart, you have an overview of all the items you have selected so far, the price, and the quantity. You can change the quantity of each item by entering the desired amount in the “Quantity” field. If you want to remove a specific item, click on the “x” mark to the left of the product image. Once you have completed your selection of desired items and decided to purchase, press “Proceed to Checkout” at the bottom of the screen. You will access the order summary where you need to enter your personal information and the address to which you want the purchased goods delivered. The delivery amount and payment method options will also be displayed. You can choose to pay by bank transfer (virman/e-banking), PayPal, cash on delivery (COD), or by cards.

If the Seller is unable to deliver all the ordered items for any reason, they will deliver those currently in stock and will contact the Buyer via phone or email regarding the delivery time and/or inability to deliver the remaining items. The Buyer can either accept or cancel the delivery of the remaining items. If the Buyer decides to cancel the remaining part of the order and has already made a payment, the Seller will refund the money within 7 working days of receiving the cancellation notice, depositing it into the Buyer’s account.

The order is considered received when the Buyer completes the order electronically and the order number, along with a successful order confirmation, is displayed on the screen. You will receive an order confirmation notification at the email address entered in the electronic form.

If you do not receive an order confirmation notification, it is suggested to check:

  • If the message ended up in your Junk/Spam folder
  • If your mailbox is full
  • If the items are still in the cart after logging into our site, and if not, please repeat the ordering process

Occasionally, we gift a discount or free delivery coupon to our newsletter subscribers and Facebook, Instagram friends.

The coupon consists of one word or a string of characters. To apply the discount, you need to enter the exact text and/or characters on the coupon and confirm it. The discount will be automatically calculated. The field for entering the coupon is located in the “Cart” at the bottom of the screen “Do you have a coupon?” After that, click on “Apply Coupon.”

Coupons may be limited by duration and the number of uses. Discounts may also apply only to one product, a limited selection of products, or a promotion. All discount rules will be clearly indicated when sending the coupon. Coupons for individual items are valid only if the item is not already on a specific promotion or in a package with a free product. A coupon for a cart discount is valid only if the cart does not contain an item already on promotion or an item with a free product. Coupons cannot be combined. Discounts do not accumulate.

LOYALTY PROGRAM – HUG LOYALTY CUSTOMER

How to Become a HUG LOYALTY CUSTOMER? To become a HUG LOYALTY CUSTOMER, you need to subscribe to the Newsletter, and you will receive a discount on all regular assortment products in the webshop with your first order. A greater discount is applied with the second order, and the largest discount is achieved with the third order, which then becomes a permanent discount. This makes you a HUG LOYALTY CUSTOMER. There is no time limit for the loyalty program. Current promotions, discounts, or coupons are not combinable with the HUG LOYALTY PROGRAM. Discounts do not stack.

Discounts on all products:

  • 5% on the first order
  • 10% on the second order
  • 15% on the third and all subsequent orders

PAYMENT FOR ORDERS

The customer agrees to pay for the ordered products, including possible delivery costs, to Luminus Mod d.o.o. using one of the following payment methods:

  • Cash on delivery (cash or card upon receipt)
  • Bank transfer (general payment slip or internet banking)
  • PayPal
  • Credit cards
  • KEKS Pay

Cash on Delivery (Cash)

Products ordered this way are shipped immediately, and the delivery person (GLS) will charge you upon delivery.

Bank Transfer

After selecting this payment method, you will receive an automatic email with the order confirmation. This email contains all the details you need for the payment: the account number to which you need to transfer the amount and the order number. Using your bank’s e-banking service, transfer the specified amount to the provided account. If you do not use e-banking, print the order confirmation and pay the specified amount at any location where you usually pay your bills. Your order will be shipped upon receipt of payment.

PayPal Payment

PayPal is one of the most popular alternatives to credit card payments worldwide. It offers e-money, or real online cash, that can be used in the virtual world just like cash is used in the physical world. PayPal’s popularity stems from the fact that it allows users to make payments in web stores without leaving their credit card or bank account numbers, thereby protecting the privacy of their data. PayPal is not a bank, but it operates very similarly. Users must open a personal PayPal account, which they can fund directly from their bank account or credit card. When paying by credit card on our web store, you use MyPOS – an advanced system for secure online card payments.

Additionally, the Financial Conduct Authority (FCA) in the UK has authorized the company as an electronic money institution, under whose supervision it operates, and it complies with the Payment Services Regulations 2017 and the Electronic Money Regulations 2011.

MyPOS is registered as a data controller with the Personal Data Protection Commission under number 0050022. All customer data is collected, transmitted, and stored in accordance with the provisions of Directive 95/46/EC on the protection of personal data and the Bulgarian Data Protection Act of 2002 (and its amendments).

The personal data provided by the merchant or third parties, such as state or international authorities responsible for fraud prevention, are stored electronically on servers located in Tier 4 data centers in Class A jurisdictions in Europe, providing the highest levels of communication, security, and access control.

SHIPPING AND DELIVERY

Delivery is carried out by the GLS courier service and is available throughout the entire territory of the Republic of Croatia except for some islands.

Ordered items are delivered within 2-4 working days from the day of order or payment receipt (usually within 2 days). Exceptionally, due to the unavailability of certain items, unforeseen circumstances, or possible delays in delivery from our suppliers, the delivery may take longer than the stated period, about which you will be informed by phone or email. If the GLS courier cannot find you at the specified address, you will be left a notice to contact them and arrange delivery at another time.

The delivery cost for ordered products valued up to €39.00 is additionally charged at €3.99.

Free delivery is available for all ordered products valued at €39.01 or more, regardless of the delivery location within Croatia.

We ship within the Republic of Croatia.

For shipping to other countries, please contact us or check during the checkout process when entering the desired delivery address. In the case of shipping to other countries, the purchaser is responsible for paying taxes and customs according to the laws of the destination country.

Ordered goods will be packed in a way that prevents damage during normal handling in transport. The customer is obliged to check for any possible damage upon receipt of the ordered goods and immediately report it to the delivery worker who delivered the goods, and refuse to accept the delivered goods with visible external damage.

RIGHT TO UNILATERAL CONTRACT TERMINATION

Luminus Mod d.o.o. cannot guarantee that the products and services on hugyourlife.hr will meet your needs. If you are not satisfied with the delivered product, you have the right to return it within 14 days. We extend this period to a total of 30 days for returns and will refund your money. According to the Regulation on the Content and Form of Information on the Right of Consumers to Unilaterally Terminate Contracts Concluded at a Distance and Contracts Concluded Outside Business Premises (NN 72/2014), the Customer is authorized to unilaterally terminate the contract without stating the reasons.

Calculation of the Period for Unilateral Contract Termination
You can unilaterally terminate the contract within 14 days without giving any reasons (we extend this period to a total of 30 days for returns). To exercise the right to unilaterally terminate this Contract, you must inform us of your decision to unilaterally terminate the contract before the expiration of the period through an unequivocal statement sent by mail, fax, or email, in which you will state your name and surname, address, phone number, fax number, or email address. You can also use the attached standard form for unilateral contract termination.

Standard Information Form for Unilateral Contract Termination

The period for unilateral termination is 14 days from the day when you or a third party designated by you, who is not the carrier, took possession of the goods. We extend this period to a total of 30 days for returns.

Refund of the Paid Amount

If you unilaterally terminate this Contract, we will refund the money we received from you, including delivery costs, without delay and no later than 14 days from the day we received your decision to unilaterally terminate the contract, unless you chose a different type of delivery that is not the cheapest standard delivery we offered. The refund will be made in the same manner as you made the payment. If you agree to another method of refund, you will not bear any costs in relation to the refund. We can only perform the refund after we have received the goods back or after you have provided proof that you sent the goods back to us.

Return of Goods

You are considered to have fulfilled your obligation on time if you send or deliver the goods to us or the person we have authorized to receive the goods (GLS) before the expiration of the above period.

The costs of returning the goods are borne by Luminus Mod d.o.o.

Consumer Responsibility for Diminished Value of Goods

The customer is responsible for any diminished value of the goods resulting from the handling of the goods, except for what was necessary to establish the nature, characteristics, and functionality of the goods. A sample form for unilateral contract termination, which is available on our website, can be filled out electronically and sent. We will send you a confirmation of receipt of the notice of unilateral contract termination without delay by email.

EXCLUSION OF THE RIGHT TO UNILATERAL CONTRACT TERMINATION

The consumer does not have the right to unilaterally terminate the contract if:

  • The service contract has been fully performed by the trader, and the performance began with the explicit prior consent of the consumer and their acknowledgment that they will lose the right to unilaterally terminate the contract if the service is fully performed.
  • The subject of the contract is goods or services whose price depends on changes in the financial market that are beyond the trader’s control and may occur during the consumer’s right to unilaterally terminate the contract.
  • The subject of the contract is goods made to the consumer’s specifications or clearly personalized.
  • The subject of the contract is perishable goods or goods with a short expiration date.
  • The subject of the contract is sealed goods that are unsuitable for return due to health or hygiene reasons, if unsealed after delivery.
  • The subject of the contract is goods that, due to their nature, are inseparably mixed with other items after delivery.
  • The subject of the contract is the delivery of alcoholic beverages whose price was agreed upon at the time of the contract, and delivery can only take place after 30 days if the price depends on market changes beyond the trader’s control.
  • The consumer has specifically requested a visit from the trader to perform urgent repairs or maintenance. If, during such a visit, the trader provides additional services or goods other than those required for the urgent repairs or maintenance, the consumer has the right to unilaterally terminate the contract regarding those additional services or goods.
  • The subject of the contract is the delivery of sealed audio or video recordings or computer programs that were unsealed after delivery.
  • The subject of the contract is the delivery of newspapers, periodicals, or magazines, except for subscription contracts for such publications.
  • The contract was concluded at a public auction.
  • The subject of the contract is the provision of accommodation services not intended for residential purposes, the provision of goods transport services, car rental services, food and beverage delivery services, or services related to leisure activities if the contract specifies that the service is provided on a specific date or period.
  • The subject of the contract is the delivery of digital content not delivered on a physical medium, if the performance of the contract began with the explicit prior consent of the consumer and their acknowledgment that they will lose the right to unilaterally terminate the contract.

ONLINE DISPUTE RESOLUTION

Under a special EU regulation, from 15.02.2016, it will be possible to resolve disputes related to online purchases throughout the EU via the ODR platform, accessible here. This means that if you encounter a problem during an online purchase within the EU (e.g., defective product, inability to replace the product, etc.), you can submit your complaint more quickly and easily through the above link. The platform can be used by both consumers and traders, and the complaint can be submitted in any of the 23 official EU languages.

OUT-OF-COURT CONSUMER DISPUTE RESOLUTION

In case of a dispute, we inform you that you can use mechanisms for out-of-court consumer dispute resolution by initiating the out-of-court dispute resolution process by submitting a complaint to the body responsible for alternative consumer dispute resolution operating in the Republic of Croatia (the Court of Honour of the Croatian Chamber of Commerce, the Mediation Centre at the Croatian Chamber of Commerce).

RESPONSIBILITY FOR MATERIAL DEFECTS / PRODUCT COMPLAINTS

The seller is responsible for material defects of the items sold on their website in accordance with the applicable regulations of the Republic of Croatia, particularly the Obligations Act.

Ordered products are packaged in a way that prevents damage during normal handling in transport/delivery.

In case the shipment is damaged during transport, such damage is visible upon receipt of the shipment, and we suggest that the buyer does not accept the shipment. We kindly ask buyers to contact us so that we can check the condition of the shipment as soon as possible and send a new one.

Upon receiving the goods, it is the buyer’s responsibility to verify the correctness of the order and compare the received items with the invoice. If anything is missing, the buyer must immediately file a written complaint, as subsequent complaints will not be considered.

In case of visible defects of the product upon receiving the shipment, the buyer is not obligated to accept the delivered product and may refuse to accept it without bearing the delivery costs. It is considered that products that have been properly received by the buyer did not have any visible defects. The buyer has the right to lodge a complaint regarding material defects within the periods and for the reasons prescribed by the provisions of the Obligations Act. The buyer can send a written complaint via email to hug@luminusmod.hr or in writing to the address: Luminus Mod d.o.o., Dankovečka 12, 10000 Zagreb, marked as Complaint.
The buyer has the right to complain about the goods in the following cases:

  • Delivery of goods not ordered
  • Delivery of goods with an expired shelf life
  • Delivery of goods with defects or damages

If the product has a hidden defect (a defect that could not be detected by normal inspection upon receipt of the item), which the buyer discovers after opening the product, the buyer has the right to unilaterally terminate the contract and get a refund, replace the product, eliminate the defect, or get a price reduction.

The seller will consider the complaint valid if, upon inspection of the product, it is found to meet the conditions for a complaint in accordance with the Obligations Act and the Consumer Protection Act. In this case, within 15 days of receiving a valid complaint, the seller will replace the product or refund the full amount paid, thereby terminating the contract. If the complaint is found to be invalid, the seller will inform the buyer within 15 days of receiving the complaint. The seller’s response will be sent in the primary language of the webshop or, if possible, in the buyer’s language.

The seller will fully accept the return of damaged, defective, or incorrectly delivered goods at their expense if it is determined that the complaint is justified and that the buyer did not influence the correctness, damage, or any defect of the goods.
In case of a justified complaint, the buyer has the right to terminate the contract with a full refund or to replace it with a correct, undamaged, and valid product. If it is not possible to deliver another product, the seller will compensate the buyer for the return shipping costs and the value of the goods that can no longer be delivered. The buyer does not have the right to return products that have been opened and used, and are hygienically sound. All goods sold by the seller are correctly stored in their original packaging. The shelf life indicated on the packaging is valid only if the goods are properly stored, as indicated on the label.

ELECTRONIC COMMUNICATION

By visiting and using the hugyourlife.hr website, you accept communication via electronic means. This means that you accept that all agreements, notices, announcements, and other content provided to you electronically satisfy legal frameworks as if they were made in writing. If the visitor or user does not have an email address or enters an incorrect one or is unable to receive emails due to technical reasons, the seller is not obliged to attempt to notify the user in another way about the order or any other details related to the order, delivery, payment, refund, complaint, and so on. By selecting the option to Subscribe to the Newsletter, you give us your consent to include you in our marketing and other activities via electronic means.

All ratings and comments are provided exclusively by customers who have experience with the product. No review can be displayed unless the product has actually been purchased.
